2008 Mother's Day Poem
Competition
OFFICIAL RULES, TERMS & CONDITIONS.
1. Timing: The competition begins April 06, 2008 and ends on
May 07, 2008 at 11:59 PM (EST).
2. Eligibility: The author must be
over 18 years of age. Employees, officers, directors and immediate family
members (defined as parents, spouses, children, siblings and grandparents) of
the Companies employees, as well as promoters, their respective related
companies and agents are NOT eligible. By participating, all entrants agree to
abide by these official rules and regulations and the decisions of the Company,
which are final and binding.
3. How to Enter: The competition can only
be entered through the Company website. Submit your entry using the Company
Submission Form on or before May 07, 2008.
4. Selection of
Potential Winner: Winning is contingent upon fulfilling all the Companies'
requirements, rules, terms and conditions. The Company will judge all entries
within 5 business days of the contest ending date. The winner will be notified
via e-mail and phone within 7 business days of the judging. If the potential
winner cannot be reached within two business days of the first attempt to
contact him/her an alternate entrant will be selected and subject to the same
guidelines as stated above. If the alternate winner does not comply, a third
winner will be selected from the eligible entries received, and so forth, until
one eligible winner is selected by the Company. Providing a working email
address and telephone number is mandatory, and is the sole responsibility of the
entrant.
5. Prize: The winner will receive a genuine Loose Diamond
certified by E.G.L International Laboratories and graded by E.G.L. to be at
least a 19 point J Color, SI2 Clarity Princess Shaped Loose Diamond. No
substitution, assignment or transfer of prize permitted. Winner is solely
responsible for any and all applicable fees and taxes associated with prize
receipt and use. The prize will be delivered to the winner within 14 business
days from the date of the selection.
6. Publicity: Except where
prohibited, participation in the competition constitutes consent for the Company
to use the winner's entry, name, opinions, hometown and state for promotional
purposes in any media without further consent, consideration or payment.
7. Supervision: The competition is overseen by the management of the
Company.
8. General Conditions: The Company, at its sole discretion,
reserves the right to disqualify any individual it finds tampering in any way
with the entry process. The Company reserves the right to cancel or modify the
competition in cases of fraud, technical failures or any other factor beyond
reasonable control, compromising the integrity of the competition, as determined
by the Company. In such event, the Company reserves the right to award the prize
at its discretion from among the eligible entries received up to the time of the
impairment. Any attempt to deliberately undermine or damage the legitimate
operation of the Company or any other promoter's website may be in violation of
criminal and civil laws. The Company and the promoters reserve the right to
prosecute and seek damages from any persons involved.
9. Release: By
submitting the entry, the contestant agrees to release and not hold responsible
the Company, their respective related companies and each of their respective
officers, directors, employees and agents from and against any claim or cause of
action, arising out of participation in the competition or receipt or use of any
prize.
10. Limitations of Liability: The Company is not responsible for:
(1) incorrect or inaccurate transcription of entry information or late, lost,
stolen, illegible, incomplete, misdirected, or entries received through
impermissible or illegitimate channels, all of which will be disqualified; (2)
technical failures of any kind, including but not limited to, the malfunctioning
of any telephone, computer, network, hardware or software; (3) the
unavailability or inaccessibility of any service; (4) unauthorized human
intervention in any part of the entry process or the competition; (5) electronic
or human error which may occur in the administration of the competition or the
processing of entries; or (6) any injury or damage to persons or property,
including but not limited to, entrant's computer, which may be caused, directly
or indirectly, in whole or in part, from entrant's participation in the
competition or from downloading any material from the Company or promoters'
website(s), regardless of whether the material was prepared by the company,
promoter, or a third party, and regardless of whether the material is connected
to the company's or promoter's website by a hypertext link.
11.
Disputes: Entrant agrees that: (1) any and all disputes, claims, and causes of
action arising out of or connected with this competition or any prizes awarded
shall be resolved individually, without resort to any form of class action; (2)
any and all claims, judgments and awards shall be limited to actual
out-of-pocket costs incurred, including costs associated with entering this
competition, but in no event attorneys' fees; and (3) under no circumstances
will any entrant be permitted to obtain awards for and entrant hereby waives all
rights to claim punitive, incidental and consequential damages and any other
damages, other than for actual out-of-pocket expenses, and any and all rights to
have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW
THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL
DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. The company and promoter in
connection with the competition, shall be governed by, and construed in
accordance with, the laws of the state of New York, without giving effect to any
choice of law or conflict of law rules (whether of the state of New York or any
other jurisdiction), which would cause the application of the laws of any
jurisdiction other than the state of New York. All state and local laws and
regulations apply.
12. Multiple Entries: Each person is eligible for an
unlimited number of entries to the competition.
13. Official
Rules: In order to be eligible to win the 2008 Mother's Day Poem
Competition entrees must be sent to the Company via the website entry page. The
poem should comply with the following criteria:
» The words “Princess Diamonds” or “Princess Diamond” must appear at least once in the poem.
» All texts must be submitted in form of a poem and must not exceed 50 lines.
» The text is original and owned by the contestant.
» The author must be over 18 years of age.
» Texts can only be submitted via the electronic web form.
» No international copyright laws may have been breached in the texts.
» All contestants must submit a valid name, email and phone number.
» Confirmation of entries will be recognized by a 'Thank You' from the website.
» Entries that do not comply with the rules will be disqualified.
» A&W Diamonds llc has full rights to publish and/or use all entries as we see fit.
14. Judges: Judges will
be appointed to review and grade every application according by the company.
15. Copyright: Copyrights remain with the authors. All participants must
first agree to assign publication rights to the Company, plus permission to
include the entry or any part of the entry on any website seen fit by the
Company.
